Tearing Down Obstacles, Finding A Way For You

What To Do When The Police Pull You Over For DWI

You have just been pulled over! What do you say to the officer?

Most people have no idea how to speak with an officer after being pulled over for suspicion of a DWI. The first moments after you have been stopped by law enforcement can be crucial. Call The Maddox Law Firm immediately! Do not leave anything to chance and be careful not to volunteer information.

“Have you been drinking?” “How much did you drink?”

These are the types of questions that catch people unaware and usually establish the beginning of probable cause to arrest for DWI. How or if you answer questions can prove crucial; your future may depend on it.

The amendment to the U.S. Constitution known as the Fifth Amendment is probably one of the most misunderstood and abused rights in the Bill of Rights. It says that you do not have to answer any law enforcement questions if you believe that your answer may incriminate you. This does not mean you can or should lie to police; it simply means that you can remain silent.

Secure The Maddox Law Firm team as soon as possible. We have a war chest of experts waiting to defend your rights.

If you are an alleged first-time offender, you should know that we have helped many secure diversion programs or even have their charges dismissed.

The DWI Breath Test/BAC Test

You were asked to take a breath test! Now what?

“Do I take the breath test, or do I refuse the breath test?” “Do I have a right to choose what test I take?”

Contrary to popular opinion, you do not have a right to choose what test you take. If law enforcement requires you supply a urine sample instead of a breath sample, and you refuse and request another test, you will be deemed to have refused the test entirely.

Understand that a refusal to submit a Breathalyzer or other blood alcohol test will automatically result in harsher DMV penalties against your privilege to drive. You will suffer a longer suspension if you are found to have refused a breath or other blood alcohol test. The risks are serious, whether or not you have been driving for under an hour or for more than three hours, the time period law enforcement uses to determine if you may be legally intoxicated.

You do not have to wait for the officer to finish with all the tests and questions before you begin your defense. Our DWI defense lawyers are equipped with several legal strategies that can help protect your rights from the very first moment you make contact with police until the trial, and at every stage after that.

Do you want to know what your next steps should be? You have options.
